HOW TO ENTER

Individuals who receive the Australian NetGuide Newsletter or purchase the Australian NetGuide Magazine during the Promotional Period must visit www.netguide.com.au and correctly complete the online entry form and submit it during the Promotional Period.

TERMS AND CONDITIONS

  1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
  2. Entry is only open to Australian residents. Employees and their immediate families of the Promoter, participating outlets and their agencies associated with this promotion are ineligible.
  3. The Promoter reserves the right to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who tampers with the entry process or who submits an entry that is not in accordance with these Terms and Conditions. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
  4. Only one entry per household per promotion permitted.
  5. Promotion commences with the June 2008 release of the Australian NetGuide Magazine on 14/05/08. Final entries close with the sale of the last issue of the May 2009 Australian NetGuide Magazine or at 23:59 EST on 14/04/09, whichever occurs first (Promotional Period). Various promotions will take place during this Promotional Period on the dates advised. The draws will take place at 54 Park Street, Sydney, NSW 2000 at 11:00 EST (or EDST as the case requires) on the dates advised throughout the Promotional Period with the final draw taking place on 17/04/09. Winners will be notified by mail and/or telephone and the names of winners of prizes valued at over $100 will be published on www.netguide.com.au within 2 weeks of the draw with the final publication date published on www.netguide.com.au on 01/05/09. Promoter’s decision is final and no correspondence will be entered into.
  6. Prizes include: Computer software and computer peripherals such as keyboards, mice and DVD burners. No prize will exceed $400.00.
  7. The Promoter accepts no responsibility for any variation in the prize value. Prizes, including any unused portion, are not transferable or exchangeable and cannot be taken as cash.
  8. If the winner of a major prize is under the age of 18 years, the prize will be awarded to the winner's nominated parent or guardian.
  9. The Promoter may conduct such further draws at the same place as the original draw as are necessary on the dates and times specified, which will be a minimum of 3 months after the initial draw date, in order to distribute any prizes unclaimed by the specified date. In the event of any winners of prizes over $100, their names will be published on www.netguide.com.au on the dates specified, which will be no more than 28 days after the unclaimed prize draw date.
  10. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
  11. Any costs associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used. Any contact details entered incorrectly on the website shall be deemed invalid.
  12. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) a prize.
  13. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, prize suppliers and as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period unless otherwise advised, use the information for promotional, marketing and publicity purposes including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
